About the Firm

We Recover Your Wages-No Matter Your Status

At Robert Wisniewski PC, we don’t make empty promises. For nearly 30 years, we’ve been fighting for the rights of Polish workers across New York City-from Greenpoint and Ridgewood to construction sites in Manhattan. We know the tactics of dishonest employers-and we know how to make them pay.

Why Polish workers in NY trust Attorney Wisniewski:

Results without paperwork
We recover back pay and overtime (up to six years!), even if you don’t have a Green Card, Social Security number, or were paid in cash.
Million-dollar successes
Our track record speaks for itself: $1,050,000 recovered in a class-action lawsuit and $960,000 for a construction worker. These are real dollars directly in our clients’ pockets.
Protection and support
We represent you even if you were fired for disciplinary reasons or if your employer has declared bankruptcy to avoid responsibility.
Free consultation
There’s no cost to you. Call us, we assess your case, and take action-no upfront fees.
You have the right to your hard-earned money. Don’t let fear of immigration status stop you from claiming what’s yours.

FAQ

Can I recover my wages if I don’t have a Green Card or work permit?

Absolutely. In New York, your immigration status does not affect your right to compensation for unpaid wages or work-related accidents. Your work is just as valid as anyone else’s.

What if my employer paid me in cash “under the table”?

You still have a strong case. Courts accept other forms of evidence-like your notes, schedules, photos, or witness statements-to prove the hours you worked. Employers are responsible for keeping records, and if they don’t, the court often rules in your favor.

How much does it cost to hire your firm?

We provide a free initial consultation to evaluate your case. Most of our work is on a contingency basis, which means you don’t pay anything unless we successfully recover money for you.

I was fired for disciplinary reasons. Can I still claim back pay?

Yes. Being terminated-even for disciplinary reasons-does not eliminate your right to payment for work you already performed.

What happens if a company declares bankruptcy?

Some employers use bankruptcy to avoid paying. We have experience pursuing claims against owners who close one business and reopen under a new name. We fight to ensure you get the compensation you deserve.
